Terms of Service
1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of AgencyTracker Pro, a software application operated by AgencyTracker Pro, LLC ("AgencyTracker Pro," "we," "our"). By creating an account or using AgencyTracker Pro, you agree to be bound by these Terms. If you do not agree, do not use the service.
2. Eligibility
AgencyTracker Pro is intended exclusively for use by licensed insurance agents and their authorized team members. By using AgencyTracker Pro, you represent that you are at least 18 years of age, a licensed insurance agent or employed by one, and authorized to enter into this agreement.
3. Acceptable Use
You agree to use AgencyTracker Pro only for lawful purposes and in accordance with these Terms. Specifically, you agree NOT to:
- Enter, upload, or otherwise input any personally identifiable information about insurance customers or consumers, including but not limited to names, addresses, telephone numbers, dates of birth, social security numbers, or policy numbers.
- Enter, upload, or otherwise input any information that constitutes a trade secret, confidential information, or proprietary information of any insurance carrier or other entity, including the carrier with which you are appointed.
- Use AgencyTracker Pro to extract, transfer, share, or otherwise distribute customer or carrier data between your agency and any other agency or carrier.
- Use AgencyTracker Pro to compete with the insurance carrier with which you are appointed, or to facilitate any activity that would violate your agreement with that carrier.
- Connect AgencyTracker Pro to any insurance carrier's internal systems via API, scraping, or any other automated means.
- Use AgencyTracker Pro in any manner that would violate applicable law or any policies of your insurance carrier regarding outside business activities, customer data, or vendor relationships.
AgencyTracker Pro is designed with input validation and structured fields intended to prevent the entry of personally identifiable customer information. However, the user remains responsible for ensuring that all information entered into the application complies with these Terms and with all applicable laws and carrier policies.
4. User Responsibility for Carrier Compliance
You are solely responsible for ensuring that your use of AgencyTracker Pro complies with all rules, policies, and agreements applicable to you, including any restrictions imposed by the insurance carrier with which you are appointed. AgencyTracker Pro is not affiliated with, endorsed by, or connected to any insurance carrier, including State Farm Mutual Automobile Insurance Company. The fact that AgencyTracker Pro is designed for use by insurance agents does not imply any affiliation with any specific carrier.
5. Account Security
You are responsible for safeguarding the credentials used to access AgencyTracker Pro and for all activity that occurs under your account. You agree to notify AgencyTracker Pro immediately if you suspect any unauthorized access or use of your account.
6. Subscriptions, Fees, and Cancellation
AgencyTracker Pro is provided on a subscription basis. Fees and billing terms are presented at the time of subscription. You may cancel your subscription at any time, in which case your access will continue through the end of the current paid period. Refunds, if any, will be governed by the cancellation policy in effect at the time of cancellation.
7. Intellectual Property
AgencyTracker Pro and all associated software, designs, trademarks, and content are the property of AgencyTracker Pro, LLC. You may use AgencyTracker Pro only as expressly permitted by these Terms. The data you enter into AgencyTracker Pro remains your data, and AgencyTracker Pro does not claim ownership of it.
8. Disclaimers
AgencyTracker Pro is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by law, AgencyTracker Pro disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AgencyTracker Pro does not warrant that the service will be uninterrupted, error-free, or completely secure.
9. Limitation of Liability
To the maximum extent permitted by law, AgencyTracker Pro, LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of or inability to use AgencyTracker Pro. The total cumulative liability of AgencyTracker Pro for any claim relating to these Terms or the service will not exceed the amount you paid AgencyTracker Pro in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless AgencyTracker Pro, LLC against any claims, damages, or expenses arising from your violation of these Terms, your misuse of the service, or your entry into the application of information that should not have been entered under Section 3 above.
11. Termination
AgencyTracker Pro reserves the right to suspend or terminate your access to the service at any time if you violate these Terms, or if continued provision of service to you would, in our reasonable judgment, expose AgencyTracker Pro or other users to legal or compliance risk.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify users by email and post the updated Terms on agencytrackerpro.com. Your continued use of the service after a change becomes effective indicates your acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Iowa, without regard to its conflict-of-laws principles. Any dispute arising from or relating to these Terms will be resolved exclusively in the state or federal courts located in Linn County, Iowa.
